When a city, county or other local government contracts with an ambulance company to provide 911 service, there are a host of legal, financial and compliance considerations that all parties must closely consider.  Where exclusive providers are selected through an open, competitive bidding process, there are state procurement laws, antitrust considerations and other important issues under state and federal law. Anytime there are fees requested or received by the local government - and offered or paid by a private EMS company – the federal anti-kickback statute comes into play (and sometimes with enormously expensive consequences, as some EMS agencies have learned). Even the “reimbursement” of first response or dispatch fees can have legal consequences if not properly structured.  This session will address these and other significant issues that must be addressed whenever local 911 contracts are entered.
